Welcome to the website and online services of Elskyte Properties LLC doing business as Elskyte Property Management (“Elskyte Property Management,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, resident portal, owner portal, and related property management services (collectively, the “Services”). 

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services. 

 

1. Use of Services 

  • The Services are provided for informational, communication, and property management purposes only. 

  • You must be at least 18 years old to use our Services. 

  • You agree to provide accurate information when creating accounts, submitting applications, or making payments. 

  • By submitting your information or contacting Elskyte Property Management, you agree to our [Privacy Policy] and consent to receive communications, including SMS, in connection with your inquiry or lease. 

  • Use of our Services is subject to compliance with all applicable local, state, and federal housing laws and rental guidelines. 

 

2. Accessibility & Fair Housing 

Elskyte Property Management is committed to compliance with all federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other protected status. We also make reasonable accommodations in our Services to ensure accessibility for individuals with disabilities. 

 

3. Resident Portal 

  • Access to the resident portal is provided as a convenience for communication, maintenance requests, and online rent payments. 

  • You are responsible for maintaining the confidentiality of your login credentials. 

  • Online payments may be subject to third-party processing fees. Elskyte Property Management is not responsible for technical errors, payment delays, or third-party failures. 

 

4. Owner Portal 

  • Property owners may access reporting and financial information through the owner portal. 

  • The information provided is for reference only and may be subject to reconciliation or adjustment. 

  • Owners remain responsible for ensuring the accuracy of banking information provided for distributions or contributions. 

 

5. Application & Leasing Terms 

  • Submission of a rental application does not guarantee approval. 

  • Applications may be subject to third-party screening, including credit, criminal background, rental history, and eviction checks. 

  • Application fees, deposits, or holding fees are non-refundable unless otherwise required by law. 

 

6. Maintenance Requests 

  • Non-emergency maintenance requests may be submitted through the resident portal. 

  • Emergency issues (e.g., fire, flooding, gas leaks, loss of heat in winter, or loss of air conditioning in extreme heat) must be reported by phone to the emergency maintenance line. 

  • Elskyte Property Management is not responsible for delays in addressing emergencies submitted through the resident portal or email. 

 

7. Communications Policy 

  • By providing your contact information, you consent to receive communications from Elskyte Property Management through any reasonable channel, including but not limited to phone calls, text messages (SMS/MMS), emails, resident or owner portal notifications, and video conferencing platforms. 

  • Communications may include account notices, leasing information, payment reminders, maintenance updates, promotional offers, or other messages related to your lease, ownership, or inquiry. 

  • Some communications may be sent using automated systems. Standard carrier or data rates may apply. 

  • You may opt out of promotional text messages or emails by following the opt-out instructions provided, but you may still receive non-marketing communications that are necessary to your lease, ownership, or account. 

  • You may opt out of SMS by replying STOP; however, opting out may limit our ability to communicate with you regarding urgent or time-sensitive matters. 

  • By engaging in video conferencing or recorded calls, you acknowledge that meetings may be recorded for training, compliance, or record-keeping purposes (where permitted by law). 

 

 

8. Payment Terms 

  • Payments made through the Services are processed by third-party vendors. 

  • By making payments, you authorize applicable charges including rent, fees, and other amounts due under your lease or management agreement. 

  • Late fees, returned payment fees, and other charges may apply as outlined in your lease or agreement. 

 

9. Rewards & Benefit Programs 

  • From time to time, Elskyte Property Management may offer resident or owner benefit programs, including rewards, credits, insurance options, or discounts. 

  • These programs may be modified or discontinued at any time without notice. 

  • Rewards or credits have no cash value and are not transferable unless expressly stated. 

 

10. Third-Party Services 

  • Our Services may include access to third-party vendors (e.g., payment processors, insurance providers, rewards partners). 

  • Elskyte Property Management is not responsible for the performance, policies, or content of third-party services. 

  • Use of third-party services is subject to the provider’s own terms and conditions. 

 

11. User Conduct 

You agree not to: 

  • Use the Services for unlawful or fraudulent purposes. 

  • Interfere with or disrupt the security, functionality, or availability of the Services. 

  • Impersonate any person or misrepresent your affiliation with Elskyte Property Management. 

 

12. Insurance Requirements 

  • Residents may be required to maintain renters insurance with specified coverage amounts as outlined in their lease. 

  • Proof of insurance may be requested at any time, and failure to maintain required coverage may result in fees or lease violations. 

 

13. Account Security 

  • You are responsible for maintaining the confidentiality of your account credentials. 

  • Elskyte Property Management is not liable for unauthorized account activity if you fail to safeguard your login information. 

  • You must immediately notify us if you suspect unauthorized access to your account. 

 

14. Disclaimers 

  • The Services are provided “as is” without warranties of any kind. 

  • We do not guarantee uninterrupted or error-free operation of the resident or owner portals. 

  • Third-party links or services are provided as a convenience, and we are not responsible for their content or practices. 

 

15. Limitation of Liability 

To the fullest extent permitted by law: 

  • Elskyte Property Management shall not be liable for any indirect, incidental, or consequential damages arising from use of the Services. 

  • Our total liability for any claim shall not exceed the amount you paid (if any) to access the Services in the past 12 months. 

 

16. Force Majeure 

Elskyte Property Management shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of government, labor disputes, internet outages, or other force majeure events. 

 

17. Dispute Resolution (Optional Arbitration Clause) 

  • Any dispute arising out of or relating to these Terms or the Services may be resolved through binding arbitration, except where prohibited by law. 

  • Arbitration shall be conducted on an individual basis; class actions are not permitted. 

  • You may choose to opt out of arbitration within 30 days of first accepting these Terms by notifying us in writing. 

 

a. Tenant and Landlord Disputes 

  • Any disputes arising under a lease agreement are governed by the terms of that lease. Elskyte Property Management acts as the property manager and is not a party to lease disputes beyond its role as agent for the property owner. 

  • Tenants must resolve disputes regarding lease obligations (e.g., rent, maintenance responsibilities, deposits) through the procedures outlined in their lease agreement and applicable housing laws. 

b. Owner (Landlord) and Elskyte Property Management 

  • Any disputes between property owners and Elskyte Property Management regarding management services are governed by the property management agreement in place with that owner. These Terms of Use apply only to website and portal services. 

c. Vendor and Realtor Disputes 

  • Vendors, contractors, and real estate professionals must resolve disputes under their written agreements with Elskyte Property Management. If no written agreement exists, services are considered “as is” and Elskyte Property Management assumes no liability for verbal or informal commitments. 

d. General Communications Disputes 

  • By using our Services, all parties (tenants, owners, vendors, and agents) agree first to attempt informal resolution of any disputes by contacting Elskyte Property Management in writing. 

  • If disputes cannot be resolved informally, they shall be handled under the binding arbitration clause set forth in Section [Dispute Resolution]. Arbitration will be conducted on an individual basis, and class or collective claims are not permitted. 

 

18. Termination 

We may suspend or terminate your access to the Services at any time for violation of these Terms or misuse of our systems. 

 

19. Governing Law 

These Terms shall be governed by and construed under the laws of the Commonwealth of Pennsylvania (for Pennsylvania properties) and the State of New York (for New York properties), without regard to conflict-of-law principles. 

 

20. Changes to Terms 

We may update these Terms from time to time. Updates will be effective upon posting to the website. Continued use of the Services indicates acceptance of the revised Terms.
